  • "We," "us," or "our" refers to Evermore, a senior living community located in Bangkok, Thailand
  • "Resident" refers to individuals living at our community
  • "Agreement" refers to the formal residence agreement entered into between Evermore and residents or their representatives
  • "Website" refers to our online presence accessible via domain and all associated pages

2. Acceptance of Terms

By accessing our website, contacting us, visiting our community, or engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.

If you do not agree with these terms, please do not use our website or services.

We reserve the right to modify these Terms and Conditions at any time. Changes become effective immediately upon posting to our website. Continued use of our services following changes constitutes acceptance of modified terms.

3. Eligibility

Our services are designed for individuals aged 60 years and older who require independent or assisted living support. Family members, legal representatives, and other authorized individuals may engage with our services on behalf of prospective or current residents.

By using our website or services, you represent that you have the legal capacity to enter into binding agreements. If you are acting on behalf of someone else, you represent that you have appropriate legal authority to do so.

4. Service Description

Evermore provides senior living accommodations and care services in Bangkok, Thailand, including:

  • Independent Living apartments with support services
  • Assisted Living suites with personalized care
  • Dining services and meal preparation
  • Housekeeping and maintenance
  • Activity programming and social opportunities
  • Health monitoring and care coordination

Specific services, amenities, and care levels are detailed in individual residence agreements. We reserve the right to modify services based on operational needs, regulatory requirements, or resident safety considerations.

Service availability is subject to capacity and appropriate match between resident needs and our capabilities.

5. Residence Agreements

Admission to Evermore requires execution of a formal residence agreement between the resident (or their authorized representative) and our community. This agreement includes:

  • Monthly fees and payment terms
  • Services included and additional services available
  • Care plan details and assessment procedures
  • Termination conditions and notice requirements
  • Resident rights and responsibilities
  • Dispute resolution procedures

Residence agreements are month-to-month arrangements unless otherwise specified. Either party may terminate with 30 days written notice, subject to conditions outlined in the agreement.

6. Payment Terms

Monthly Fees: Residents are billed monthly in advance for accommodations and included services. Payment is due on the first day of each month. Late payments may incur fees as specified in the residence agreement.

Accepted Payment Methods: We accept bank transfers, checks, and credit cards (Visa, Mastercard). Processing fees may apply to certain payment methods.

Fee Adjustments: Monthly fees may be adjusted with 60 days written notice to reflect increased costs, service enhancements, or changes in care levels.

Deposits: A refundable security deposit equal to one month's fees is required before move-in. This deposit is returned within 30 days of departure, less any charges for damages beyond normal wear.

Refund Policy: Monthly fees are non-refundable once the month begins. If residence terminates mid-month, no prorated refunds are provided unless otherwise specified in the residence agreement.

7. User Responsibilities

When using our website or services, you agree to:

  • Provide accurate, complete, and current information
  • Update information promptly when changes occur
  • Use our website and services lawfully and respectfully
  • Not interfere with website functionality or security
  • Respect intellectual property rights
  • Comply with all applicable laws and regulations

Residents and families agree to:

  • Participate in care planning and assessment processes
  • Provide complete and accurate health information
  • Respect other residents, staff, and community guidelines
  • Pay fees promptly according to agreement terms
  • Notify staff of changes in health status or needs
  • Maintain appropriate behavior consistent with community standards

8. Intellectual Property

All content on our website, including text, images, logos, graphics, and design elements, is the property of Evermore or its licensors and is protected by Thai and international copyright laws.

You may view, download, and print pages from our website for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our written permission.

The Evermore name and logo are trademarks. Unauthorized use of our trademarks is prohibited.

9. Disclaimers

Website Information: Information on our website is provided for general informational purposes. While we strive for accuracy, we make no warranties regarding completeness, accuracy, or reliability. Website content should not replace professional medical advice or formal consultations.

Service Outcomes: While we provide quality senior living services, we cannot guarantee specific health outcomes, improvements, or results. Individual experiences vary based on numerous factors including health status, care plan adherence, and personal circumstances.

Service Availability: We reserve the right to modify, suspend, or discontinue services temporarily or permanently with reasonable notice, except in emergencies requiring immediate action.

10. Limitation of Liability

To the fullest extent permitted by Thai law, Evermore shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury or property damage not caused by our negligence
  • Outcomes beyond our reasonable control including natural health progression, pre-existing conditions, or external factors

Our total liability for any claim arising from our services shall not exceed the amount paid by the resident for services during the three months immediately preceding the claim.

These limitations do not affect liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under Thai law.

11. Indemnification

You agree to indemnify and hold harmless Evermore, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms and Conditions
  • Your violation of any law or third-party rights
  • Your use of our website or services
  • Information you provide being inaccurate or misleading

12. Termination

Website Access: We may suspend or terminate your access to our website at any time for violation of these terms, misuse of services, or other reasons we deem appropriate.

Residence Termination: Either party may terminate residence agreements according to the terms specified in the individual agreement. Grounds for termination by Evermore include:

  • Non-payment of fees
  • Behavior posing safety risks to residents or staff
  • Care needs exceeding our capabilities
  • Material breach of agreement terms
  • Providing false information during application process

Upon termination, residents are responsible for removing personal belongings within agreed timeframes. Outstanding balances remain due.

13. Dispute Resolution

Informal Resolution: We encourage residents and families to address concerns directly with management. Most issues can be resolved through open communication.

Mediation: If informal resolution fails, parties agree to attempt mediation before pursuing formal legal action. Mediation costs are shared equally unless otherwise agreed.

Arbitration: Disputes not resolved through mediation may be submitted to binding arbitration in Bangkok, Thailand, conducted in accordance with Thai Arbitration Institute rules. Arbitration decisions are final and enforceable in Thai courts.

This clause does not prevent parties from seeking injunctive relief or protection of intellectual property rights through courts.

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them enforceable while maintaining the original intent.

16. Waiver

Our failure to enforce any provision of these terms does not constitute a waiver of that provision or our right to enforce it in the future. Waivers must be in writing and signed by authorized representatives to be effective.

17. Assignment

You may not assign or transfer your rights or obligations under these Terms and Conditions without our written consent. We may assign our rights and obligations to any successor entity in the event of a merger, acquisition, or sale of assets.

18. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any executed residence agreements, constitute the entire agreement between you and Evermore regarding use of our website and services. These terms supersede all prior communications and proposals.
